API Terms of Use

These API Terms of Use (“API Terms”) govern your access to and use of the Termimal API (the “API”) provided by Hiram OÜ (“we”, “us”). They supplement our Terms of Service. By using the API, you agree to these API Terms.
1. Eligibility
API access is available only to users on a paid plan that includes API access. Each API key is bound to a single user account and may not be shared, resold, or transferred.
2. Authentication and keys
You are responsible for keeping your API key confidential. Any request authenticated with your key is deemed to be made by you. Notify us immediately at security@termimal.com if you suspect your key has been compromised; we will rotate it.
3. Rate limits
The API is subject to rate limits documented in the API Reference. We may modify limits with reasonable notice. Sustained or wilful breach of rate limits may result in throttling, key suspension, or termination.
4. Permitted use
You may use the API to power your own internal tools, dashboards, research, and analytics. You may build features for your end users provided that:
- (a) your end users do not gain raw access to underlying third-party data we license (e.g. price ticks);
- (b) you do not expose the API directly to the public internet without authentication;
- (c) you comply with the redistribution restrictions in section 5.
5. Prohibited use — Redistribution
You may not, and may not permit any third party to:
- (i) redistribute, resell, sublicense, or republish raw data obtained via the API;
- (ii) create a substitute or competing data service from the API;
- (iii) cache or store API responses for longer than reasonably necessary to operate your application, and in any case no longer than 24 hours for real-time price data;
- (iv) extract, scrape, or systematically download data outside of normal API usage;
- (v) circumvent rate limits or authentication.
6. Prohibited use — Machine-learning training
You may not use any data, output, or response obtained via the API to train, fine-tune, evaluate, or benchmark any machine-learning model, language model, or AI system, whether for your own use or for any third party.
7. No SLA
The API is provided “as is” and “as available” without any service-level agreement, uptime guarantee, or warranty of fitness for any purpose. We may modify, deprecate, or remove endpoints with reasonable notice. We do not warrant the accuracy or completeness of any data returned by the API.
8. Indemnification
You agree to indemnify and hold harmless Hiram OÜ from any third-party claim arising out of (a) your use of the API, (b) your end users’ use of any application you build with the API, (c) your breach of these API Terms, or (d) any redistribution of API data in breach of section 5.
9. Liability
Our total aggregate liability arising out of or in connection with the API is capped at the lesser of (i) EUR 100 or (ii) the API fees paid by you in the 12 months preceding the event giving rise to the claim. The mandatory consumer carve-out in EU law continues to apply where relevant.
10. Suspension and termination
We may suspend or terminate API access immediately, without refund, if we reasonably believe you have breached these API Terms or the Terms of Service. We will notify you of the basis for suspension and give you an opportunity to cure where the breach is curable.
11. Governing law and jurisdiction
These API Terms are governed by Estonian law. Disputes are subject to the exclusive jurisdiction of Harju County Court (Harju Maakohus), Tallinn, Estonia, subject to mandatory EU consumer protections where applicable.
